BMW Warranty Provisions

Introduction
During the warranty period, all repairs covered by the warranty will be performed at no charge to the customer by the BMW dealer or BMW Authorized Service Partner. Thus, the warranty includes the cost of labor and parts. Maintenance and adjustment work will be charged to the BMW owner during the warranty period. External influences include damage caused by climatic, chemical, thermal, mechanical or other influences, such as sand, brine, storms, tree resin, overhead wires, stone chips, industrial pollution and fecal matter. Normal wear is defined as wear from the use of, for example: brake and clutch linings, and windshield wiper rubbers.

Scope of the warranty
Your BMW dealer or BMW Authorized Service Partner guarantees in accordance with the state of the art of the type BMW the freedom from defects of the vehicle for three years beginning on the day of the first registration certificate.

The warranty applies worldwide. The warranty obligation of your BMW dealer or BMW Authorized Service Partner also covers parts not manufactured by BMW itself, with the exception of tires. Regarding these parts, the warranty is limited to the same warranty that your BMW dealer or BMW Authorized Service Partner has obtained from the respective manufacturer or supplier. A warranty claim exists only if the defect is reported to your BMW dealer or BMW Authorized Service Partner without delay, within the warranty period, after becoming aware of it, and if a warranty claim is also made in the process. This warranty does not affect your statutory rights and claims.

Content of the warranty
If a warranty is granted, your BMW dealer or BMW Authorized Service Partner has the choice, which is determined by the requirements of technology, to repair the defect or replace the part in question. If your BMW dealer or BMW Authorized Service Partner recognizes a warranty claim, the costs of disassembly and assembly shall be borne by the BMW dealer or BMW Authorized Service Partner, provided that the repair of the defect is carried out by a BMW dealer or BMW Authorized Service Partner in accordance with BMW guidelines. Only those parts showing the defect as well as those damaged by this defect will be replaced. Replaced parts are the immediate property of your BMW dealer or BMW Authorized Service Partner.

Exclusion of warranty
Warranty entitlement does not exist if:

  • the defect has not been reported by the customer immediately, within the warranty period, after its discovery to a
    BMW dealer or BMW Authorized Service Partner (hereinafter, the "Report");
  • the dealer was not given an immediate opportunity to remedy the defect after Report;
  • the car or its components were improperly handled or overloaded, such as in motor racing competitions;
  • the car was used for purposes other than those for which it was constructed;
  • the car was not repaired or serviced according to factory specifications prior to the Report.
  • parts were installed in the vehicle that did not match the quality level of original BMW
    parts;
  • the car or parts thereof has/have been inexpertly altered;
  • the instructions for handling and maintenance of the car as contained in
    your car's manual, but not limited to it, are not observed;
  • maintenance and repair of the car have not been performed according to the manufacturer's specifications and strictly in accordance with the prescribed service intervals in a timely manner;
  • invitations for a recall/recall are not acted upon;
  • tires not recommended by BMW are fitted;
  • the usage profile leads to deep discharge of the battery requiring replacement;
  • engine tuning has taken place without the use of original BMW engine tuning products;
  • If there is normal wear and tear;
  • damages are caused by external influences

There is never any entitlement to compensation for indirect damages.

Warranty on replaced parts
Parts fitted to rectify the defect are under warranty until the end of the warranty period for the vehicle.

Transfer of ownership
If ownership of the vehicle is transferred, the warranty obligations remain unaffected.

Warranty against rusting through from the inside and on paintwork
In addition to the aforementioned warranty, the following applies to new cars: for a period of twelve years after the first registration of the registration certificate, a warranty is granted on the entire bodywork against the consequences of rust damage caused by causes from the inside. The warranty period on paintwork is three years after first registration. Should rust and/or paint damage occur within this period, it will be repaired by or on behalf of a BMW dealer or BMW Authorized Service Partner, without charging labor and material costs to the owner of the BMW. The warranty against rust-through and on paintwork does not apply to optionally and/or standard-mounted attachments. In order to claim the described warranty, it is necessary, that the following conditions are fulfilled:

  • car maintenance is performed in a timely manner according to factory guidelines;
  • damage repairs to the bodywork must be professionally performed in accordance with the manufacturer's guidelines using original BMW body parts or body parts that match the quality level of original BMW body parts, by a BMW dealer or BMW Approved Service Partner or a bodyshop approved by him.

Explanation
You are entitled to free remedies in the event of a conformity defect relating to your car. These remedies are not affected by the manufacturer's warranty. The manufacturer's warranty constitutes a commitment in addition to the statutory conformity warranty. BMW Nederland B.V., located in Rijswijk at Einsteinlaan 5 (2289 CC) acts as guarantor. If you believe that you are entitled to a warranty, please contact the BMW dealer or BMW Approved Service Partner to this end. Of course, you are responsible for the appearance of your vehicle. In keeping your vehicle in optimal condition, the following points are very important:

  • In order not to give the development of rust due to external influences a chance, it is necessary that you take care of proper maintenance. The best way to do this is described in your car's manual.

The 12-year warranty on your car's bodywork remains in effect even if you change ownership.
