MINI Warranty Provisions

INTRODUCTION
During the warranty period, all repairs covered by the warranty will be performed at no charge to the customer by the MINI dealer or MINI Authorized Service Partner. Thus, the warranty includes the cost of labor and parts. Maintenance and adjustment work will be charged to the MINI owner during the warranty period. External influences include damage caused by climatic, chemical, thermal, mechanical or other influences, such as sand, brine, storms, tree resin, overhead wires, stone chips, industrial pollution and fecal matter. Normal wear and tear is understood as wear and tear due to the use of, for example: brake and clutch linings, and windshield wiper rubbers.

CURRENT OF THE WARRANTY
Your MINI dealer or MINI Authorized Service Partner guarantees, in accordance with the state of the art of the type MINI, that the car will be free of defects for three years beginning on the date of the first registration certificate.

The warranty applies worldwide. The warranty obligation of your MINI dealer or MINI Authorized Service Partner also includes parts not manufactured by MINI itself, with the exception of tires. Regarding these parts, the guarantee is limited to the same guarantee that your MINI dealer or MINI Service Partner has obtained from the manufacturer or supplier. A guarantee claim can only be made if the fault is reported to your MINI dealer or MINI Approved Service Partner without delay, within the guarantee period, as soon as it becomes known, and if a guarantee claim is also made. This guarantee does not affect your rights and claims under the law.

CONTENT OF THE WARRANTY
If a warranty is granted, your MINI dealer or MINI Authorized Service Partner has the choice, which is determined by the requirements of the technology, to repair the defect or to replace the part in question. If your MINI dealer or MINI Approved Service Partner recognizes a warranty claim, the costs of disassembly and assembly will be borne by the MINI dealer or MINI Approved Service Partner, provided that the repair of the defect is carried out by a MINI dealer or MINI Approved Service Partner in accordance with MINI guidelines. Only those parts that show the defect as well as parts damaged by this defect will be replaced. Replaced parts are the immediate property of your MINI dealer or MINI Authorized Service Partner.

EXCLUSION OF WARRANTY
Warranty entitlement does not exist if:

• the defect was not reported by the customer to a MINI dealer or MINI Authorized Service Partner immediately, within the warranty period, after its discovery (hereinafter, the "Report");
• the dealer was not given an immediate opportunity to remedy the defect after Report;
• the car or its components were improperly handled or overloaded, such as in motor racing competitions;
• the car was used for purposes other than those for which it was constructed;
• the car was not repaired or serviced according to factory specifications prior to the Report.
• parts were installed in the car that do not match the quality level of original MINI parts;
• the car or parts thereof has/have been inexpertly altered;
• the car handling and maintenance instructions contained in your car manual, but not limited to these, are not observed;
• maintenance and repair of the car have not been performed according to the manufacturer's specifications and strictly in accordance with the prescribed service intervals in a timely manner;
• invitations for a recall/recall are not acted upon;
• tires not recommended by MINI are fitted;
• the usage profile leads to deep discharge of the battery requiring replacement;
• engine tuning has taken place without the use of original MINI engine tuning products;
• If there is normal wear and tear;
• damages are caused by external influences.

There is never any entitlement to compensation for indirect damages.

WARRANTY ON REPLACED PARTS
Parts fitted to rectify the defect will be warranted until the end of the warranty period of the vehicle.

TRANSFER OF OWNERSHIP
In the event of a transfer of ownership of the vehicle, the warranty obligations will remain in full force.

WARRANTY AGAINST INNER BODY CROSS AND PAINTING
In addition to the above warranty, the following applies to new cars: for a period of twelve years from the first registration date, the entire bodywork is guaranteed against the consequences of rust damage caused by internal causes. The warranty period on paintwork is three years after first registration. If rust and/or paint damage should occur within this period, it will be repaired by or on behalf of a MINI dealer or MINI Authorized Service Partner, without charging labor and material costs to the MINI owner. The warranty against rusting through and on paintwork does not apply to optionally and/or standard-mounted attachments. In order to claim the described warranty, it is necessary, that the following conditions are met:

• car maintenance is performed in a timely manner according to factory guidelines;
• Damage repairs to the bodywork must be professionally carried out in accordance with factory guidelines using original MINI body parts or body parts that match the quality level of original MINI body parts, by a MINI dealer or MINI Approved Service Partner or a body repair shop approved by them.

NOTICE
You are entitled to free remedies in the event of a conformity defect relating to your car. These remedies are not affected by the manufacturer's warranty. The manufacturer's warranty constitutes a commitment in addition to the legal conformity warranty. MINI Nederland B.V., located in Rijswijk at Einsteinlaan 5 (2289 CC) acts as guarantor. If you believe you have a warranty claim, you can contact your MINI dealer or MINI Authorized Service Partner for this purpose. Of course, you are responsible for the appearance of your car. In keeping your car in optimal condition, the following points are very important.

• In order not to give the development of rust due to external influences a chance, it is necessary that you take care of proper maintenance. The best way to do that is described in your car's manual.

The 12-year warranty on your car's bodywork remains in effect even if you change ownership.
